Welcome to Madadgar. These Terms of Service ("Terms") govern your access to and use of our platform, services, and applications. Please read these Terms carefully before using our services.
1. Acceptance of Terms
By accessing and using Madadgar ("the Platform"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services. These Terms apply to all users, including clients, service providers, and visitors.
2. Service Description
Madadgar is an online marketplace that connects clients with verified service providers across various categories. We facilitate bookings, payments, and communications but are not directly responsible for the services performed by providers. The Platform serves as an intermediary to enable service transactions.
3. User Accounts
- Registration: You must provide accurate, complete information when creating an account.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials.
- Age Requirement: You must be at least 18 years old to use our services.
- Account Suspension: We reserve the right to suspend or terminate accounts that violate these Terms.
4. Service Providers
- Verification: All providers must complete verification including background checks and document submission.
- Qualifications: Providers must possess necessary skills, certifications, and licenses for their services.
- Service Quality: Providers agree to deliver services professionally and meet quality standards.
- Commission: A 15% platform fee is charged on each completed booking.
- Taxes: Providers are responsible for all applicable taxes on their earnings.
5. Client Responsibilities
- Accurate Information: Provide correct service details, location, and contact information.
- Availability: Be available at the scheduled time or communicate changes in advance.
- Payment: Pay the agreed amount after service completion.
- Respectful Conduct: Treat providers with respect and professionalism.
6. Booking and Cancellation
- Booking Confirmation: Bookings are confirmed once a provider accepts the request.
- Cancellation Policy: Free cancellation up to 2 hours before scheduled time. Cancellations within 2 hours may incur a fee.
- No-Show: If either party fails to show without notice, penalties may apply.
- Rescheduling: Both parties can request rescheduling subject to mutual agreement.
7. Payment Terms
- Payment Methods: We accept cash, credit/debit cards, and digital wallets.
- Pricing: Service prices are set by providers and displayed during booking.
- Platform Fee: A service fee is included in the total booking amount.
- Refunds: Refund requests are reviewed case-by-case and processed within 5-7 business days.
- Disputes: Payment disputes must be reported within 24 hours of service completion.
8. User Conduct
You agree NOT to:
- Violate any laws or regulations
- Impersonate another person or entity
- Harass, threaten, or abuse other users
- Post false, misleading, or fraudulent information
- Attempt to circumvent payment systems
- Use the Platform for any illegal activities
- Collect user data without consent
- Interfere with Platform operations or security
9. Intellectual Property
All content on the Platform, including logos, text, graphics, software, and design, is owned by Madadgar or licensed to us. You may not copy, reproduce, distribute, or create derivative works without written permission. User-generated content (reviews, photos) grants us a non-exclusive license to use for Platform purposes.
10. Disclaimers
- Service Quality: We do not guarantee the quality, safety, or legality of services provided by third-party providers.
- Background Checks: While we verify providers, we cannot guarantee complete accuracy of background information.
- Availability: We do not guarantee uninterrupted access to the Platform.
- Third-Party Links: We are not responsible for content on external websites linked from our Platform.
11. Limitation of Liability
To the maximum extent permitted by law, Madadgar and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid through the Platform in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Madadgar, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or violation of any rights of another party.
13. Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you consent to our data practices as described in the Privacy Policy.
14. Dispute Resolution
- Negotiation: We encourage users to resolve disputes through direct communication.
- Mediation: Unresolved disputes will be subject to mediation before legal action.
- Jurisdiction: These Terms are governed by the laws of Pakistan. Legal disputes will be resolved in the courts of Islamabad.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Platform after changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.
16. Termination
We may terminate or suspend your account and access to the Platform immediately, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is harmful to us or the Platform. Upon termination, your right to use the Platform will immediately cease.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
